Terms and conditions of sale

Article 1: General Provisions

These General Terms and Conditions of Sale (GTC) apply, without restriction or reservation, to any Buyer wishing to purchase the Works offered on the website www.notseig.fr .

An “Buyer” is defined as any individual or legal entity acting for purposes unrelated to its commercial, industrial, artisanal, or professional activities, who wishes to purchase a Work offered for sale on the website www.notseig.fr.

The sale of Artworks is open to persons who have the legal capacity to enter into contracts under applicable law.

The term “Artwork” shall mean any work of art presented on the website www.notseig.fr with a description enabling the Buyer to ascertain its essential characteristics (title, dimensions, medium, technique, etc.) as well as its price.

These Terms and Conditions are the only ones applicable, to the exclusion of all others. Upon the actual purchase of one or more Works on the websites www.notseig.fr, the Buyer will be asked to review and accept these General Terms and Conditions of Sale. The Buyer will confirm that they have read and accepted these Terms and Conditions by checking the box “I have read and accept the Terms and Conditions ”. By checking this box, the Buyer therefore fully and unreservedly accepts all of these General Terms and Conditions of Sale. No sale of Artwork on the website www.notseig.fr will be considered without acceptance of these Terms and Conditions.
The seller “Notseig” reserves the right to cancel or refuse, without delay, any order that it deems disputable or fraudulent and/or any order placed by a Buyer with whom there is a past or ongoing dispute of any kind.

These terms and conditions may be modified at any time without notice.

Article 2: Privacy and Personal Data Protection

Data is collected for the sole purpose of establishing a commercial and professional relationship with Buyers. Personal data is retained by the website for a reasonable period of time. If the Buyer does not provide all required information in the website’s forms (* required fields), they cannot submit the form and, consequently, cannot place their order.

In accordance with the French Data Protection Act of January 6, 1978, the Buyer may request changes to their personal data or demand to be removed from the website’s database by contacting the website via email at notseig@gmail.com.

Article 3: Prices:

The artworks are sold unframed.

The prices listed are net prices payable in euros for Buyers residing in metropolitan France, excluding shipping costs.

If the Buyer orders a Work on the website to be shipped to a country other than mainland France, the Buyer acknowledges that they are the importer of said Work.

For purchases shipped to a country outside the European Union, any charges, local taxes, or customs duties are not the responsibility of the seller and will be borne by the Buyer. It is the Buyer’s responsibility to familiarize themselves with import requirements and to declare their purchase to the authorities in their country.

Article 4: Ordering a Work

Purchasing a Work on the website involves a multi-step process:

Selection – The Buyer may add one (or more) Artwork(s) they wish to purchase to their shopping cart by clicking on the “Add to Cart” icon available on the Artwork’s detail page. Adding an Artwork to the shopping cart does not constitute a reservation of the Artwork. The shopping cart remains accessible and editable at any time while the Buyer is logged in to the site www.notseig.fr.

“My Cart” page – In the cart, the Buyer can select the Artworks they actually wish to purchase by removing unwanted Artworks and after selecting a shipping method. The Buyer may proceed with the order by clicking on the “Checkout ” icon. Please note that this action does not make the Work unavailable on the website to other potential buyers.
The shipping rate applicable to an order will be displayed so that the Buyer can accept it by selecting that shipping method.

a: Filling Out the Customer Profile


The Buyer must fill out the following fields under “Billing Address”:
“Country*”
“First Name *”
“ Last Name*”
“Address *”
“Zip Code *”
“City *”
“Email Address *”
“ Phone *”

The Buyer may choose to have their order shipped to a different address by checking “Ship to a different address” and filling out the corresponding required fields.

Otherwise, the billing address will be used as the shipping address.

  1. b) Acceptance of the Terms and Conditions– In order to confirm the order and proceed to the selected payment method, the Buyer must check the box “I have read and accept the Terms and Conditions.” These Terms and Conditions are accessible on every page of the website at the bottom of the page by clicking the “Terms and Conditions” tab, as well as by clicking the hyperlink included in the statement “I have read and accept the Terms and Conditions.”

  1. c) Order Summary and Selection of Payment Method– The Buyer will then review the order summary, the delivery method, and the shipping costs, and may select the desired payment method.

Namely:
- “Payment by credit card” – Full payment online by credit card,

- “Payment by PayPal” – Full payment online or payment in 4 monthly installments.

Confirmation of payment will be provided via an email sent to the Buyer.

Unavailability of the Artwork

It is understood that in the event of an online payment by credit card or PayPal made by the Buyer for an Artwork that turns out to be unavailable, the seller, Notseig, will inform the Buyer that the order cannot be fulfilled and will refund the amounts paid within 5 (five) business days, without the Buyer being entitled to any compensation of any kind.

Article 5: Payment for a Work

Payment for the work and related shipping costs shall be made at the “Buyer’s” discretion

  • by credit card (Visa, MasterCard, American Express, other credit cards) on a secure website that guarantees the confidentiality and security of data.
  • via PayPal, either in a single payment covering the full price of the artwork and associated shipping costs, or in four (4) monthly installments.


Payment of the total amount due—namely, the net price of the artwork and the associated shipping costs—will initiate the delivery process. The artworks for sale on the website remain the property of Notseig until full payment for the artwork and the associated shipping costs has been received.

Proof of the transaction will be recorded by the website and/or its payment system, and the Buyer will be notified of receipt of the payment via email, which will serve as proof of payment.

Article 6: Delivery of the Artwork:

Notseig does not ship framed artwork.

6.1. Order Packaging:

All orders will be handed over or delivered with the invoice serving as a certificate of authenticity and packaged in protective packaging.

Depending on the delivery method selected during the Artwork reservation process, the Buyer may have their order delivered by a carrier.

6.2. Delivery Times:

Notseig will have the Artwork delivered to the address provided at the time of order within an average of 15 days. All shipments will be made by a carrier selected by Notseig, with whom Notseig will sign a delivery receipt indicating the condition of the Artwork.

Adherence to delivery times and the preservation of the Artwork’s condition during delivery depend on the carrier. Consequently, the Buyer may not claim any compensation of any kind from Notseig in the event of delayed delivery, failure to deliver, and/or delivery of a damaged Work attributable to the carrier (as evidenced by the carrier’s delivery receipt).

Similarly, pursuant to Article 1148 of the Civil Code, Notseig shall not be liable or deemed to have acted negligently in handling the Buyer’s order if any delay, failure to deliver, and/or damage to the Artwork during delivery results from a force majeure event.

6.5. Receipt of Delivery—Right of Return

The Work will be delivered to the delivery address provided by the Buyer during the ordering process. If the Buyer notices any non-conformity or apparent defect in the delivered Artwork, the Buyer must not sign the delivery receipt and must return the package to the carrier. The Buyer must immediately report the issue to Notseig, along with all relevant supporting documentation, by contacting Notseig at the email addresses notseig@gmail.com, or by phone at (33) 07 54 50 79 87.

In this case, return shipping costs will be borne by Notseig or the carrier, as applicable, and the carrier will, at the Buyer’s discretion, proceed as soon as possible to either exchange the item for one of equivalent value or issue a refund.

If these formalities are not followed at the time of delivery, the Artworks will be deemed to be in compliance and free from any apparent defects, and no claim may be validly accepted.

Article 7: 14-Day Right of Withdrawal

Pursuant to Article L.121-21 (Law of March 17, 2014 on Consumer Affairs) of the Consumer Code, the Buyer hasa period of 14 days from the date of delivery of the Artwork to exercise their right of withdrawal by contacting Notseig via email at notseig@gmail.com to request an exchange for an Artwork of equivalent value and/or a refund.
The Artwork must be returned in its original packaging and in perfect condition within 7 days of delivery. The Artwork will therefore be shipped at the Buyer’s own risk. Return shipping costs shall be borne exclusively by the Buyer.

Artworks returned damaged or soiled by the Buyer (fingerprints or marks of any other kind) will not be accepted for exchange and/or refunded.

An exchange, subject to availability, or a refund will be issued within 30 days of Notseig’s receipt of the returned Artwork in perfect condition.

Article 8: Warranties

The Work supplied by Notseig is covered, in accordance with legal provisions, by:
The statutory warranty of conformity;
The legal warranty against hidden defects arising from a defect in material, design, or manufacture that affects the delivered products and renders them unfit for their intended purpose.

Any warranty is excluded in the event of misuse, negligence, or lack of maintenance on the part of the Buyer, as well as in the event of normal wear and tear, accidents, or force majeure; and Notseig’s warranty is limited to the exchange for a work of equivalent value or the refund of the non-conforming or defective work.

Notseig warrants that the works presented on the website www.notseig.fr comply with their descriptions and the provisions of French law. In the event of a material error on the Website resulting in the delivery of the wrong Work to the Buyer, the Buyer may, at their discretion, request an exchange for the correct artwork, if available, an artwork of equivalent value, or a refund of the amounts paid, but shall not be entitled to any compensation from Notseig.

Notseig shall under no circumstances be held liable, including but not limited to the following:
- The transmission and/or receipt of any data and/or information over the Internet;
- Any malfunction of the Internet preventing the receipt and/or sending of emails, as well as the processing of an order;
- Failure of any receiving equipment or communication lines;
- The loss of any paper or electronic mail and, more generally, the loss of any data
- Delivery issues or damage occurring during transport;
- The operation of any software;
- The consequences of any virus, anomaly, or technical failure;

- Any damage caused to a Buyer’s computer;
- Any technical, hardware, or software failure of any kind that has prevented or limited the ability to place an order or has damaged a Buyer’s system.

Article 9: Intellectual Property

9.1 Intellectual Property Rights

All visual elements displayed on the website are protected by copyright, pursuant to Articles L.112-1 et seq. of the Intellectual Property Code. Under no circumstances may the Buyer use, copy, reproduce, modify, or distort this work or its elements, including on the Internet, without the prior written authorization of Notseig.

Notseig reserves the right to pursue any act of infringement of its intellectual property rights, including through criminal proceedings.

9.2 Rights to the Work

The artist holds the copyright (economic rights and moral rights) to their creation, as defined in Article L.111-1 et seq. of the Intellectual Property Code. The rights to display and reproduce the works featured on the website belong to Notseig, and its authorization is required for any use of these rights.

The Buyer’s rights to the purchased Work are therefore limited to a right of private use, excluding any right of display or reproduction.

Article 10: Force Majeure

Pursuant to Article 1148 of the Civil Code, Notseig shall not be held liable for the fulfillment of the order if any delay or failure results from a force majeure event.

Article 11: Governing Law

This contract is governed by French law. In the absence of an amicable agreement regarding its interpretation or performance, the court of Notseig’s place of residence shall have exclusive jurisdiction to hear any disputes.
